The firm provides four levels of service for trademark searches:

• Word Mark Basic search for $300.00: This includes a basic search using the U.S. Patent and Trademark Office (USPTO) database of the wordmark (name) you are considering to determine if an application will run into any trouble.
• Word Mark Comprehensive search for $500.00: In a comprehensive examination, we search for the name you have chosen using the USPTO database and other key trademark and business databases.
• Design Mark (Logo) Basic search for $1,000.00: This includes a basic search using the U.S. Patent and Trademark Office (USPTO) database of the design mark (logo) you are considering to determine if an application will run into any trouble.
• Design Mark (Logo) Comprehensive search for $2,000.00: In a comprehensive examination, we search for the logo you have chosen using the USPTO database and other key trademark and business databases.

Attorneys at the firm can also assist with registering and filing trademark applications. This includes:

• Word Mark Application Package for $750.00 (not including filing fees): Even after careful research and preparation, many trademark applications are subject to action by the USPTO and may be denied. McClanahan Powers offers a complete registration package that includes drafting the application, filing the application, and responding to any non-substantive office actions from the USPTO. Any substantive responses to the USPTO are expressly not part of this fixed package but are offered at an hourly rate.
• Design Mark (Logo) Application Package for $1,000.00 (not including filing fees): Even after careful research and preparation, many trademark applications are subject to action by the USPTO and may be denied. McClanahan Powers offers a complete registration package that includes drafting the application, filing the application, and responding to any non-substantive office actions from the USPTO. Any substantive responses to the USPTO are expressly not part of this fixed package but are offered at an hourly rate.

In addition to handling searches and filing of trademarks, attorneys at the firm assist clients with:

• Trademark monitoring: Your trademark is vital to your business. You must monitor your trademark within the market to ensure that your competitors are not infringing on your rights.
• Ongoing trademark maintenance: Every five to six years and every ten years, later on, you are typically required to renew your trademark with the USPTO. This is known as a Section 8 Declaration, and it is necessary to avoid abandoning your trademark.
• Trademark compliance and use issues: Not only do you need to protect your trademark from competitors, but you also need to ensure that you are using your trademark effectively and that any licensees or franchises use your trademark correctly.

• Trademark oppositions: When you register for a trademark, there is a 30-day period for others to oppose your registration. If possible, McClanahan Powers can help you respond to oppositions and work to keep your registration moving forward. McClanahan Powers may be able also to help you oppose someone else’s application if you feel that the registration of their trademark may cause you damage.
• Trademark cancellation: When you receive a registration for your trademark, others, in some circumstances, can petition to cancel your trademark registration. If possible, McClanahan Powers can help you respond to such a petition and work to keep your registration active. McClanahan Powers may be able also to help you attempt to cancel someone else’s registered trademark if you feel that the continued registration of their trademark may cause you damage.
